In 2002 prostitution became a legally recognised occupation and no longer immoral in the eyes of the law. Brothels were tolerated before, but are now legal. Sex workers’ social and legal security was to be improved through the ProstG and the first steps taken towards destigmatisation. Sex workers finally received rights.

We can now legally claim our earnings, ie: sue our clients if necessary. Furthermore, our occupation is no longer deemed immoral in the eyes of the law.

However, this is not that groundbreaking because in most cases in our line of work, payment is collected before the service is carried out. Nevertheless, there have been cases of sex workers suing their clients and as far as we know, the sex worker has won each of these cases. Therefore, suing the client may well be worth it if necessary.

Sex work was legal before the Prostitution Law, but it was considered immoral. We were tolerated, but were not able to do things like access health insurance or open bank accounts given our job designations. Since the passage of the Prostitution Law, this is now possible. We have had to pay taxes even before the Prostitution Law, even though it is often falsely believed that only since the Prostitution Law took effect, sex workers have been paying taxes.

Our working conditions have improved since our occupation is no longer considered immoral. Before the Prostitution Law, operating a brothel or a similar venue was seen as promoting prostitution and was therefore illegal. In this way, all brothel operators were involved in criminal activity. It’s no wonder that there weren’t any classy or upscale brothels! How should one be expected to invest in a brothel when it could be shut down at any time? Since then, our workplaces have become more comfortable and we have a greater choice of places to work.

We can sue our clients if they fail to pay us. Only the sex worker can file a claim in her/his own name and may not be represented by someone else.

Why did they come up with this clause? It is assumed that most of us have a pimp who controls our earnings, so the idea behind this clause is to ensure that the sex worker, rather than the pimp, will receive the financial compensation from the claim.

As a sex worker, you may work as an employee with social protections. However, your employer may only determine when and where you work, but not how, with whom or to what extent (limited managerial authority).

The idea behind this paragraph is the undisputed fact that many sex workers have insufficient or no social protection. However, lawmakers did not primarily have health insurance in mind, but rather lack of pension and unemployment insurance. Undoubtedly, sex workers face problems accessing these, but this is a common deficit among all low salary professions typically on a self-employed basis. Another problem that arose was that as an employee, one is generally subject to managerial authority, meaning that one must do the work assigned by the boss. In a brothel, this would mean that sex workers would have to serve every customer, regardless of whether the sex worker wants to or not.

This presents a challenge, which is why Paragraph 3 is intended to limit the authority of the manager. An employed sex worker can only be told when and where to work, so s/he could theoretically arrive at work and sit on the sofa all day, turn down every customer, and would still have a right to her pay. It’s no wonder that there are so few employed sex workers in Germany.

The driving assumption behind the ProstSchG is that sex workers are victims and need protection. As a result, our rights have become limited and replaced by obligations. These include mandatory health counselling, registration and condom usage. Registration is only possible if you are legally allowed to work in Germany. Brothel owners may only allow registered sex workers to work in their venues.

Everyone who offers any kind of sexual and erotic service to physically present others in exchange for money. This includes brothel and street workers as well as escorts, BDSM providers, tantric and erotic massage providers, regardless of how much time is committed to sex work.

Sex work business operators include all venue owners (ie: brothels, tantra massage studios), sex work event organisers, and all intermediary service operators (ie: escort agencies).

If two sex workers share an apartment for work, then this counts as a type of brothel and requires a permit.

As of 2009 there is a health insurance requirement in Germany. If you are self-employed you may choose to either be insured by a public or a private provider. Private insurances are generally cheaper at first, but increase with age. Transferring from a private to a public provider is often difficult and from the age of 55 no longer an option. If you are not insured and decide to apply for insurance later, you will most likely need to pay retrospectively for the time you weren’t insured.

Emergency medical treatment is free in Germany.

With your health certificate you can go to the agency responsible for registration—this is still to be determined in most states, and may be the police, the public order agency, or the local business agency. You will need to appear at the agency personally and may not bring along anyone else.

Information needed includes your name, current address, birth date and place, nationality, and in which cities you work. If you work in more than one city, you should register in the city where you work the most. A photo ID card will be issued to you within five days, with your work name on it as well if you like. This will need to be renewed every two years and must be carried with you during your working hours. If you are caught un-registered you will be required to pay fine and be forced to go through the registration process.

Brothel-like venues, according to the new law, include not only traditional brothels, but also “walk-in houses,” apartment brothels, and escort agencies. All of these venues will need to seek approval from both the government agencies for local business and construction/urban planning. In principle, there is nothing wrong with standards for the improvement of working conditions. Unfortunately, lawmakers have included completely unhelpful standards in the new law. An example of a new regulation that will negatively affect many sex workers is the overnight prohibition in sex work venues. Sex workers may no longer sleep overnight at their workplaces. Venue operators are required to check that all sex workers working in their venue are registered. Victims of coercion (however these are identified) and minors may not work in sex work venues.

All operators must keep a record of rent collections from sex workers working in their venue, and must provide each sex worker with a receipt including the name of the sex worker, the date of payment and the rent sum. Make sure that you always receive a receipt in order to be able to provide proof of your expenses in the event of a tax audit.
